Terms and Conditions

1. Definitions

• "Platform" refers to the Brahmanas.in website, mobile applications, and any related services.
• "User," "You," "Your" refers to any person who accesses or uses the Platform, including Devotees and Brahmanas.
• "Devotee" refers to a User who requests and books a spiritual or religious service through the Platform.
• "Brahman," "Brahmana," "Provider" refers to a qualified and verified priest or spiritual professional who has registered on the Platform to offer their services.
• "Service" refers to the spiritual, religious, or ceremonial services offered by Brahmanas and booked by Devotees through the Platform.
• "Booking" refers to the formal agreement between a Devotee and a Brahmana for the performance of a Service.

2. Nature of the Platform

Brahmanas.in is a technology platform that acts as a marketplace to connect Devotees with Brahmanas. You acknowledge and agree that Brahmanas.in is a neutral facilitator and is not a direct provider of spiritual or religious services. Brahmanas are independent contractors and are not employees, agents, or partners of Brahmanas.in. We are not responsible for the conduct, actions, or omissions of any User of the Platform.

3. User Accounts and Eligibility

Eligibility: You must be at least 18 years old and capable of entering into legally binding contracts to use this Platform.

Account Creation: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Terms for Brahmanas (Providers)

Verification: You agree to undergo our multi-step verification process, which may include identity verification (CKYC, DigiLocker), bank account verification (Razorpay), and qualification checks. You represent and warrant that all information and documents you provide are true and accurate.

Profile Accuracy: You are responsible for keeping your profile information, including services offered, pricing, availability, and biography, accurate and up-to-date.

Service Fulfillment: You agree to perform all booked Services with the utmost professionalism, reverence, and adherence to Vedic traditions as described in your profile.

Conduct: You agree to maintain a high standard of conduct and communication with Devotees. Any form of misconduct may result in immediate suspension or termination of your account.

Independent Contractor Status: You acknowledge that you are an independent contractor. You are solely responsible for your own taxes, insurance, and other legal obligations.

5. Terms for Devotees (Clients)

Booking: When you make a Booking, you agree to pay all applicable fees, including the Service Fee, Platform Fee, and any applicable taxes.

Accurate Information: You agree to provide accurate and complete information required for the Service, including the correct address, date, and time.

Safe Environment: You are responsible for providing a safe, clean, and appropriate environment for the Brahmana to perform the Service.

Samagri (Materials): The responsibility for arranging the required materials (samagri) for the Service will be as specified in the Booking details. You agree to fulfill your obligations in this regard.

6. Payments, Cancellations, and Refunds

Fees: Devotees will be charged the Brahmana's Service Fee plus a non-refundable Platform Fee. Brahmanas agree that the Platform will facilitate the payment on their behalf.

Payment Processing: All payments are processed through our third-party payment gateway. We do not store your credit card or sensitive payment information.

Cancellation Policy:

By Devotee:

• Cancellations made more than 48 hours before the scheduled Service time are eligible for a full refund of the Service Fee.
• Cancellations made between 24 and 48 hours before the Service are eligible for a 50% refund of the Service Fee.
• Cancellations made less than 24 hours before the Service are non-refundable.
• The Platform Fee is non-refundable in all cases.

By Brahmana:

If a Brahmana cancels a confirmed Booking, the Devotee will receive a full refund (including the Platform Fee), and we will assist the Devotee in finding an alternative Provider if possible. The cancelling Brahmana may be subject to penalties, including a temporary suspension of their account.

Disputes: Brahmanas.in reserves the right to mediate any payment disputes between Devotees and Brahmanas.

7. User Content and Reviews

By posting content (such as reviews, ratings, or chat messages) on the Platform, you grant Brahmanas.in a worldwide, non-exclusive, royalty-free license to use, copy, display, and distribute such content in connection with the Platform's business. You are solely responsible for the content you post and agree not to post anything that is defamatory, obscene, or unlawful.

8. Limitation of Liability

To the maximum extent permitted by law, Brahmanas.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or (c) the performance or non-performance of any Service by a Brahmana.

9. Indemnification

You agree to indemnify and hold harmless Brahmanas.in and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Hyderabad, Telangana, India, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

11. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
